There are ‘capacity to pay’ provisions in the Energy Retail Code — a retailer must assess a customer’s capacity to pay in a timely manner, offer an instalment plan where appropriate and provide details on concessions.
Amendments in 2006 to the Electricity Industry Act and the Gas Industry Act to require each energy retailer to have a hardship policy approved by the ESC.
