A natural gas retailer billed its customers an additional charge – a 'gas market congestion charge' – for natural gas consumption in June and July 2007. It imposed the charge after ancillary payments were incurred in the gas wholesale market to maintain adequate pressures on the gas pipeline system during a cold snap.
EWOV received multiple complaints.
In early November 2007, the Essential Services Commission (ESC) decided to investigate the matter. In mid-December 2007, the ESC announced it had found that the charge was not fair and reasonable, and not compliant with Victoria's Energy Retail Code.
The retailer then ceased issuing bills with the congestion charge on them. It wrote to every customer who had already been charged to advise a credit would be applied, to refund the disallowed charge.
